Kobach Tells Elderly White Southerners About the Power of States’ Rights

Kansas Secretary of State Kris Kobach didn’t leave Birmingham Friday after offering testimony at a contentious U.S. Commission on Civil Rights briefing on the impact of restrictionist immigration laws like those enacted in Alabama and Arizona.

Instead, the nativist lawyer and author of the abovementioned bills, remained in the state to speak Saturday at an event hosted by Alabama’s Eagle Forum, a chapter of Phyllis Schlafly’s ultraconservative national organization.

Strolling in about 30 minutes after his speech was scheduled to start, a grinning Kobach was met with a standing ovation from the crowd of about 60 people – mostly senior citizens, and mostly white – who had assembled at a Marriott hotel near Birmingham to hear their champion speak.

In a 60-minute speech on “the Obama administration’s assault on states’ rights,” Kobach warned that the federal government is “turning its guns, metaphorically, directly upon the states.”

Kobach was a hit. He drew applause when he praised Alabama’s immigration law (which he authored) for going further than any other jn trying to force undocumented immigrants to leave, and got a laugh with the statement, “calling an illegal alien an undocumented immigrant is like calling a thief an undocumented owner.”

In one of the most insensitive moments of his speech, Kobach, who has pushed for strict voter ID laws despite evidence that they will disenfranchise some poor, rural, elderly and minority voters, also took on the Voting Rights Act of 1965, which outlawed poll taxes, literacy tests and other tactics designed to keep African Americans from casting ballots.

Flipping the 1965 law on its head, Kobach framed states singled out by the law for their repressive, discriminatory practices as the victims of a federal government that treats some states as “not equal” to others.

“Congress in 1965 said some states have a history of racial discrimination in voting, and so therefore these states, before you can do anything to change your election law, must get Department of Justice approval,” he told the elderly, mostly white crowd. “Well, Alabama is one of those states that has to say, ‘Mother, may I’ before you can do anything to change your election laws.”

There’s a reason for that. The U.S. Commission on Civil Rights held its first-ever hearing in Montgomery, Ala., in 1958, to investigate allegations of voter registration practices designed to bar African Americans from registering to vote. At that time, the commissioners were forced to stay at Maxwell Air Force Base because all of the local hotels were segregated. The commission’s efforts at that time were stridently opposed by arch-segregationist and future Alabama Gov. George Wallace, who, like Kobach, cast Alabama and other states subject to scrutiny as victims of a tyrannical federal government.

Later in his speech, Kobach spoke admiringly of Arizona Gov. Jan Brewer’s plan to defy the administration’s Deferred Action for Childhood Arrivals initiative, which offers temporary work permits and waivers of deportations to certain undocumented immigrants who were brought into this country as children.

But in response to an audience question about nullification – the idea, popular among Southern segregationists in the 1960s, that states can defy federal laws they see as overreaching – Kobach walked a careful line.

Stating that nullification is “pretty clearly prohibited by the Supremacy Clause,” the ex-DOJ lawyer wondered aloud what would happen if the federal government did something that was “clearly unconstitutional?”

“If something was so unconstitutional that there would be no colorable argument as to its constitutionality, what about then? Does the Supremacy Clause still apply then?” he asked rhetorically.

“And that is perhaps one of the most interesting constitutional question of all time, and who knows, maybe the Supreme Court will be forced to answer that question.”

    I remember, at the age of fifteen, being taken to the Olympia Theater to see the local premier of “The Diary of Anne Frank”. Throughout the showing, there were groans and sobs from the audience. The youngest Holocaust survivors were not yet thirty, and they, too, were there.

    I am having a hard time following the logic of the green and grey boxes, but as some one that grew up in Mississippi during the 50/60′s I can only equate the need for voter identification to the poll taxes that were required and struck down as unconstitutional. Any requirement that endangers the write to vote (or requiring the outlay of money) would by association also be unconstitutional. I am a WASP and my best friend was Jewish, with parents from the concentration camps, both had tattoos and both told me stories of the camps. A person would have to be the most ignorant sort of person to think that this never took place, just ask the 300+ US servicemen that were interred in the camps after the battle of the bulge – these are American Soldiers and not all were Jewish, they have no reason to lie or deceive. If anyone doubts the existance of the “death camps” then they only have to read the accounts of these brave men. Just because others have the right to deny the existence of history, does not mean that the future generations have to hear you.

    Because the Germans didn’t care about the bombing of civilians in Guernica, Warsaw, Rotterdam, London, Coventry, Belgrade, Leningrad, Stalingrad, etc. In the initial bombing of Stalingrad, before German troops were anywhere near the city, 40,000 civilians were killed. This is more than the deaths at Dresden, which number no higher than 35,000.

The first gas experiment was carried out in the basement of an ordinary barracks.

    Perhaps you are unaware of the very ordinary usage of Zyklon-B, the patented source of HCN in use in Germany (and the US) at the time. The Degesch instructions make clear just how complex the use of Zyklon was (not).

    It was very frequently used to kill insects such as lice in clothing and other articles, and for this purpose concentrations of around 16,000ppm were maintained for 72 hours. For comparison, a concentration of 300ppm will kill a human in about 15 minutes.

    And that commonly achieved 16,000ppm, necessary for delousing, is still far below explosive concentrations.

    In any case, the highly specialized and hermetically sealed facilities normally used for these high concentration were what we now describe as ‘tents’.

    In case you are unfamiliar with that term, it describes a fabric structure (that is, made of cloth, often canvas) supported by poles and pegs.

    Zyklon was also commonly used in residential buildings (houses and barracks) and the US Army used it in rail freight cars for at least a decade.

    No, it is not the case that people in the vicinity of the tents, houses, barracks, or rail cars were at any serious risk from the very high concentrations of HCN within these various structures. Please, consider the meaning and implications of ‘diffusion’.

    Perhaps you are unaware of this basic and easily researched industrial history, but if you’re going to pretend to make arguments about the use of Zyklon, you have no excuse for not knowing it. And if you did know it, you would not make such foolish and easily debunked suggestions.

    Bear in mind that the usage instructions from Degesch, the manufactuer of Zyklon, do not support your claims.

    Please tell us you’re not going to be foolish enough to cite Leuchter.

    Oh, and by the way, as to the ‘no vents in the gas chambers’ joke, there certainly were, and there’s a somewhat famous photo of a well-known revisionist standing in the dynamited remains of a vent.

    Mitch > Exactly. a factor of 160 is only two orders of magnitude. Gas can build up and concentrate in pools such as sink traps, and pipes. You’re assuming the gas would be evenly distributed. When dealing with any explosive gas, designers must use extreme cautious. That is why the gas chamber story is so incredulous. It could not run as assembly line production like it’s depicted in the movies.

    The state of California used to gas criminals. That state gas chamber was a complex affair with a heavy door like a submarine door and complex system to provide a negative containment enviornment and venting/purge mechanism to scrub the gas. And it would gas only one person at a time!

    Explain the big crack around the wooden door walls at the Auschwitz gas chamber? Explain why it opens from the inside and how come there’s a plate glass window that could be easily smashed? Explain the water drain in the floor that’s connected to the sewer?

    Annie – A hydrogen cyanide concentration of 3500 ppm (0.035%) will kill a human in about 1 minute. Hydrogen cyanide gas in air is explosive at concentrations over 5.6%. Thus an explosion of Zyklon B would require a 160-fold error. Th master race doesn’t make errors of such magnitude and therefore it would be inefficient to have “spark protection”. I assumed the rest of your post was equally astute so I didn’t bother to read it. I apologize for assuming you were mentally competent.

The Soviet Union suffered more than twice as many casualties as any other nation during WWII. The fact that my father made it back from Europe at all and my very existence are due in part to the heroic resistance offered by the Red Army and the Soviet people. Your racism is even more apparent due to the fact that you entirely ignore the hundreds of thousands of Japanese victims of the nuclear holocaust initiated by the USA.     I don’t think this is a difficult question. If the Supreme Court (US) says that something is within the powers of the Federal government, and also that the actions of the Federal government are constitutional, then there is no chance for a state law or ruling to overturn or block the Federal action.

    The only option would the be violence and rebellion, something I think the right wing is all too happy to envision in order to keep the poor from getting health care and to keep equal rights at bay…

    Prior to the Civil War slave states adamantly supported the notion that the supremacy clause invalidated state laws prohibiting the enforcement of the Fugitive Slave Act. Instead of pursuing legal recourse they seceded. Is Kobach suggesting Alabama do this again? If they do I hope that the traitors will be executed this time.

    The SPLC care about human slaves who died in the gold mines of Kolyma. The SPLC doesn’t care about the mass rape of 2 million German woman at the end of WWII, or the bombing of civilians in Dresden and other German cities.

    For someone who made a career of going around writing flawed laws for hire, that only ended up causing state and local governments a lot of time and money for nothing, I find it very telling that Kobach is trying to get more people on board with untenable legal pursuits.
