What I am worried about in terms of the status quo is that anyone at all in prison who speaks out about, tries to organize resistence to, or somehow makes any noise about their mistreatment while in custody can be locked away in solitary indefinitely without proof. These are not always people in prison for violent crime, but simply jailhouse lawyers or charismatic prisoners organizing a hunger strike, or otherwise rocking the boat.

This is often done via &quot;gang association&quot; accusations which are ex-judicial proceedings carried out behind closed doors without the presence of a lawyer. Mind you we are talking about a penalty which is more severe than that for assaulting a prison guard, because with gang association there is no getting out of solitary. They are simply locked away and inaccessible, with letters censored, no visits from family, and essentially isolated from human contact forever. 

The few times these cases have gone to court, the judge usually adheres to the rule of any evidence, which can amount to the prison officials stating the person in solitary is a prison gang member. When prison officials have fabricated evidence, no suits filed by prisoners have been won as far as I am aware. In fact, there is very little a prisoner in the United States can do to revindicate any human or civil right. It might as well be the Spanish Inquisition, given the prevalence of torture, rape, and failure to treat medical conditions.]]></description>
