 Rights of H-2A Workers

  • Every worker has the right to receive at least the salary promised in the H-2A contract, even if you are doing piece-rate work.

  • Write down your hours to know if you are receiving enough pay.

  • Neither your employer nor the crew leader has the right to hold your passport without your consent or to force you to work. If they are, they are breaking the law.

  • By the end of the contract, your employer has to have given you at least 75% of the hours promised in the contract. If there is not enough work, the employer has to pay you for at least 75% of the hours promised.

  • You must be reimbursed for the majority of your travel expenses (including bus or plane fares and visa costs)

  • Travel and visa costs should be reimbursed in the first week of work.
