SPLC: Judge rules First Amendment doesn’t protect neo-Nazi Andrew Anglin’s antisemitic trolling of Tanya Gersh

Chief Judge Dana L. Christensen of the U.S. District Court for the District of Montana ruled today that the First Amendment does not protect Andrew Anglin, the publisher of the neo-Nazi website Daily Stormer, from liability for his decision to launch an antisemitic “troll storm” directed at Tanya Gersh, a Jewish real estate agent in Whitefish, Montana.

In doing so, Judge Christensen agreed with an earlier recommendation by Magistrate Judge Jeremiah Lynch, who also concluded that Anglin’s troll storm deserves no First Amendment protection. 

Today’s ruling underscores what both we and our client have said from the beginning of this case – that online campaigns of hate, threats, and intimidation have no place in a civil society, and enjoy no protection under our Constitution.
