On Aug. 5, 2025, the Florida Department of Corrections (FDC) began implementing a rule that requires attorneys to obtain FDC’s preapproval every time they wish to send a piece of legal mail to people incarcerated within FDC. The rule also limits the types of legal mail that can be sent and authorizes FDC officers to review the legal mail.

On Jan. 23, 2026, a motion for summary final order was filed with the State of Florida Division of Administrative Hearings asking that the FDC’s Legal Mail Rule be declared invalid.

In the motion, plaintiffs claim the rule interferes with attorney-client communications and challenge it as unlawful.
