Defending Youth in Louisiana

Youth can change. We owe them a path forward; not the life-long stigma that comes with an adult criminal conviction.

Children prosecuted as adults face harsher penalties, longer sentences and the consequences a criminal record carries — including difficulties in finding employment and housing as well as restrictions on serving in the military or receiving financial aid for college — all before they turn 18. Studies show children housed in adult prisons are more likely to reoffend compared to those who remain within the juvenile system, which prioritizes rehabilitation and education. Moreover, they endure significant harm in adult facilities, including exposure to sexual and physical violence, isolation and suicide risk. 

In 2016, Louisiana passed the Raise the Age Act (Act 501) in order to align the state with national standards for juvenile justice. This law, which took full effect on March 1, 2019, raised the age of criminal responsibility from 17 to 18. 

Then came the rollbacks.  

In 2024, using violent crime rhetoric that isn’t supported by data, legislators approved changes that reversed progress for youth in Louisiana: 

SB 3

Mandates that 17-year-olds are considered adults within the criminal legal system. This means children as young as 17 can be arrested, prosecuted, and imprisoned in the same system as adult offenders.

Requires a youth to have served at least three years or 66% of their sentence before a judge could consider probation or another option.

SB 2 / Act 3

Authorizes a proposed constitutional amendment to appear on the March 29, 2025, ballot. Currently, the list of offenses for which youth can be tried as an adult is provided in the state constitution. (It’s all the major felonies, as you’d expect.) If approved, the Legislature will determine the list of felonies for which a child can be prosecuted as an adult.

In the few short months since legislators toppled Raise the Age, allowing 17-year-olds to be charged as adults, nearly 70% of 17-year-olds arrested in Louisiana’s three largest parishes have been jailed for nonviolent offenses. For New Orleans specifically, the 17-year-olds arrested as adults since the law change were 98% Black, with 85% of their charges for nonviolent offenses.  

If Act 3 passes, Louisiana’s legislators could pass laws to lock up more young people in adult prisons for even minor incidents like trespassing, graffiti, or possessing small amounts of marijuana.
